Sales Terms and Conditions

Voyages Planner is a SaaS travel planning solution accessible via computer, tablet, or mobile. It allows users to access a variety of planning tools and features depending on the selected subscription plan.
Detailed descriptions of available features are provided on our website voyagesplanner.com and may be updated regularly.

Acceptance of Terms:
By using Voyages Planner services, you agree to these Terms and Conditions of Sale (T&Cs).
If you do not accept these Terms, you may not access or use our services.

1. Definitions

User: Any individual with personal access to Voyages Planner, whether as:

  • an Administrator User (account creator), or
  • a Secondary User (license assigned under a collaborative account).

Each user has personal and non-transferable rights. Login credentials may under no circumstances be shared with third parties.

Account: The set of information and settings associated with an administrator and, where applicable, with secondary users through licenses.

  • The Individual Account is linked to a single administrator and does not allow the addition of other users.
  • The Collaborative Account is intended for teams and agencies, allowing the addition of multiple users through the purchase and assignment of licenses.

Client Access: Read-only access provided by the user to their end clients (main travelers or companions), within the limits of the chosen plan. This access allows clients to view a travel itinerary via a dedicated link and personal login credentials, without the ability to modify content or access other features.

2. Pricing and Payment Terms

Prices and Taxes: All prices are displayed inclusive of taxes. As a micro-enterprise under French law, Voyages Planner does not collect or charge VAT. Subscription plans include specific limitations (number of trips, client accesses, saved templates) as detailed on voyagesplanner.com.

Additional Fees: No additional fees apply beyond the subscription cost, except for specific services, such as adding trips beyond the limits of the Standard plan. These services will be billed according to the rates listed on our website voyagesplanner.com.

Payment Methods: Payments are processed exclusively via Stripe, using a credit card. We do not accept any other payment methods.

Billing Errors or Refunds: Requests related to billing errors or refunds must be submitted by email to contact@voyagesplanner.com within 30 days of the billing date or the relevant incident. We are committed to processing these requests within 14 business days.

Each subscription plan corresponds to a specific type of account:

  • Individual Account: access to Discovery, Standard, and Premium plans, reserved for a single administrator.
  • Collaborative Account: access to Discovery and Premium plans, with the option to add users through license purchase.

One license = one user. A license is considered active only when assigned to a user. Without an active license, the user cannot create new trips or modify trips created by other users on the account. Licenses are personal, non-transferable, and cannot be transferred between accounts.
Any subscription or modification made by a user binds the entire account.

3. Trip Creation

Subscribers have the following quotas depending on their plan:

  • Discovery (individual or collaborative): 2 unique trips for clients, 5 content templates saved in the library, 1 companion per client account.
  • Standard (individual only): 2 new trips per month, automatically reset on the subscription date and time. Up to 20 content templates saved in the library and 4 companions per client account.
  • Premium (individual or collaborative): unlimited trips, 200 saved templates, up to 49 companions per client account. If the number of trips created reaches 50 within the current billing month, a notification will be displayed, inviting the user to contact Voyages Planner. This check ensures compliance with these T&Cs.

Access Rules:

  • Each access (administrator or user) is strictly personal and may not be shared or transferred to third parties.
  • For Individual Accounts, only one administrator is authorized to manage the account.
  • For Collaborative Accounts, users may manage the subscription, purchase, or assign licenses to other users.
  • Each license corresponds to a unique user, who has their own personal and non-transferable access.
  • Trip creation, as well as the modification of trips created by another user on the account, are reserved for users with an active license.

4. Specific Features

  • PDF itinerary link: Available only in the Standard and Premium plans.

  • Adding companions: Not available in the Discovery plan for trips created under the administrator account. This option is only enabled on the client’s own accounts under the Discovery plan.

  • Content library: The number of saved templates varies by plan (5 in Discovery, 20 in Standard, 200 in Premium).

  • File size limits: Uploaded images are limited to 3 MB per file, and PDF files are limited to 128 MB per file.

  • Character limit: HTML content generated in the editors (itineraries, welcome messages, custom fields) is limited to a maximum of 65,000 characters.

Multi-user and licenses (collaborative accounts only):

  • Users on a collaborative account may purchase and assign licenses to other users.
  • Each license corresponds to a unique user and cannot be transferred between accounts.
  • The holder of the collaborative account (initial administrator) remains responsible for all actions carried out by licensed users, including subscription and license management.
  • Voyages Planner reserves the right to suspend or terminate licenses in case of fraudulent use (credential sharing, unauthorized access, etc.).

5. Duration and Termination

Refund Policy: Subscriptions are billed monthly. In the event of early termination, no refunds will be issued for unused billing periods. Subscribers are charged at the beginning of each billing cycle and may cancel at any time without penalty.

Termination Terms: Subscriptions can be canceled at any time via the user’s account on app.voyagesplanner.com, with no minimum commitment period.

Termination Procedure: The termination of a subscription may be carried out by any user of the collaborative account, or by the administrator in the case of an individual account. Termination must be processed through app.voyagesplanner.com and will take effect at the end of the current billing period.

Account Suspension or Termination: In case of suspension or termination of an account, all associated access, including client access, will also be suspended or revoked. The account holder will lose access to all account management features, and clients will no longer be able to view their travel itineraries.

6. Service Modifications and Suspension

Updates and Changes: Voyages Planner reserves the right to make regular updates and to add new features. Users will be notified of these changes by email.

Update Frequency: Updates are made continuously and as needed. We reserve the right to modify the services based on technical developments and user needs.

Notice of Changes: Substantial modifications to the Terms and Conditions or the services will be communicated to users via email.

7. Liability and Limitations

Liability for Data Loss: Voyages Planner cannot be held liable for data loss resulting from incorrect use of the services or from technical failures.

Liability for Errors: Voyages Planner’s liability is limited to direct damages and does not cover indirect or consequential losses, such as loss of profit or business interruption.
We do not guarantee the accuracy of information provided by users.

8. Referral Program

Voyages Planner offers a referral program allowing users to earn free subscription months by referring new users. The terms of this program are as follows:

Eligibility

Any user registered on Voyages Planner can refer a friend by sharing their referral link.
The referred person must sign up via this link and subscribe to a paid plan for both the referrer and the referee to receive the referral benefits.

Benefits

Both the referrer and the referee receive one free month once the referee subscribes to a paid plan.

For the referrer:

  • If already subscribed, the free month will be applied to the next invoice.

  • If not yet subscribed to a paid plan, the free month will be applied immediately upon subscription to the plan of their choice.

For the referee:

  • The referee must first subscribe and pay for the first month.

  • The free month will then be automatically applied to the second invoice.

Accumulation of Benefits

It is possible to refer multiple people and accumulate several free months.
Each registered and subscribed referral unlocks one additional free month for the referrer.
Free months cannot be exchanged for money or other services.

Application Terms

The free month will be applied to the next invoice of the referrer (or immediately in case of a new subscription), and to the second invoice of the referee after they subscribe to a paid plan.
Referral details can be viewed in the user’s personal space, under the “Profile / Referral” menu.

Exclusions and Restrictions

Voyages Planner reserves the right to suspend or cancel a referral if fraudulent use of the program is detected.
Voyages Planner also reserves the right to modify or terminate the referral program at any time, with prior notice to users.

9. Intellectual Property

Usage License:
Users are granted a non-exclusive, non-transferable, and limited license to use the services of Voyages Planner.
Any commercial use of the provided content or tools requires prior written authorization from us.

10. General Provisions

  • Governing Law and Jurisdiction: These Terms and Conditions of Sale are governed by French law.
    Any dispute shall be submitted to the competent courts of Avignon, unless otherwise required by law.
  • Language Precedence. In the event of any inconsistency between the French, English, and Spanish versions, the French version shall prevail.

  • Force Majeure. Voyages Planner shall not be liable for any failure caused by force majeure events under French law.

  • Severability. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

Terms of Use

1. Access and Registration

Registration Information:
When registering, users must provide their first name, last name, and email address.
They agree to keep their information accurate and up to date.

Account Security:
Users are responsible for the security of their account and must maintain the confidentiality of their login credentials.
They must immediately notify Voyages Planner of any unauthorized use of their account.

2. Use of Services

Restrictions:
Use of the services is limited by the subscribed plan, including trip quotas, saved content templates in the library, and companion accesses. Once the limits are reached, the user may either wait for the quota reset (Standard plan) or upgrade to a higher plan (Standard or Premium).

Users agree to use the services in compliance with these Terms of Use and not to misuse them. They must not lend, share, or resell their access to third parties.

  • For Individual Accounts, administrator access is strictly reserved for the account holder.
  • For Collaborative Accounts, each user has their own personal and non-transferable access. Users may manage the subscription, purchase, or assign licenses in accordance with these T&Cs. Trip creation is restricted to users with an active license.

Client access is strictly read-only, granted to end travelers via consultation links, using their personal login credentials.

Liability for Misuse:
In case of misuse, Voyages Planner reserves the right to suspend or terminate access to the services.
Users are responsible for any damage resulting from the improper use of the services.

Features and Quotas:
Specific quotas are defined for each plan (see Terms and Conditions of Sale for details).

Creation Limit in the Premium Plan:
Users of the Premium plan may create up to 50 trips per month without additional checks.
Once this limit is reached, an automatic notification is displayed asking the user to contact Voyages Planner.
This control ensures compliance with usage rules, and if appropriate, additional trip creation may be enabled after review.

Technical Limits:

  • Uploaded images are limited to 3 MB per file.

  • Uploaded PDF files must not exceed 128 MB.

  • HTML content generated in the editors (itineraries, welcome text, custom fields) is limited to 65,000 characters max to ensure optimal performance.

3. Privacy and Personal Data

Privacy Policy:
The Privacy Policy explains how we collect, use, and protect users’ personal data.
It is available on voyagesplanner.com and is compliant with the GDPR.

4. Modifications and Interruptions

Notice of Changes:
Users will be notified by email of any significant changes to the Terms of Use or to the services.

Service Interruptions:
Voyages Planner reserves the right to temporarily or permanently interrupt its services for maintenance or any other necessary reason.
We will make every effort to minimize disruptions and will notify users at least 7 days in advance of any significant planned service interruption.

5. Termination and Suspension

Conditions for Suspension or Termination:
We may suspend or terminate a user’s account in case of violation of the Terms of Use.
Users have the right to challenge the suspension or termination by contacting our customer support.
Customer support will respond to such disputes within 10 business days.
If an admin account is suspended or terminated, all associated accesses — including client accesses provided by the Travel Planner — will also be suspended or cancelled.

Rights Upon Termination:
Upon termination of an account, users may request the deletion of their personal data in accordance with our Privacy Policy.
Requests must be sent to contact@voyagesplanner.com.

6. Liability

Limitation of Liability:
Voyages Planner shall not be liable for any indirect or consequential damages resulting from the use of or inability to use the services.
Our liability is limited to the amount paid for the services during the 12 months preceding the dispute.
We are not liable for data loss or service interruptions caused by third parties.

Exclusions of Liability:
We are not responsible for any errors or omissions in the content provided through the services, including user-generated or user-provided content.

7. General Provisions

Dispute Resolution:
Disputes will be resolved primarily through mediation.
If mediation fails, disputes will be submitted to the competent courts of Avignon.

Conflict Resolution Methods:
Mediation is preferred before considering legal action.
Users are encouraged to contact our customer support with any questions or complaints before initiating legal proceedings.

8. Legal Compliance

Regulatory Compliance:
These Terms of Use comply with current regulations, including the GDPR for the protection of personal data.
Specific obligations may vary depending on the jurisdictions in which the services are offered.

9. Language and Accessibility

Language of the Documents:
These Terms (T&Cs and Terms of Use) are available in French, English, and Spanish.

Accessibility:
We strive to make our services accessible to all users.
Although no formal accessibility criteria are defined at this stage, we plan to work on improving accessibility in the future.
